SPECIAL PERMITS:

A special permit is required in order to use a vehicle which contravenes the maximum weight and dimensions set for mechanically propelled vehicles and trailers on a public road.

A local authority may in accordance with Section 13 of the Road Traffic Act 1961 and the Road Traffic (Construction and Use of Vehicles) Regulations 1963 – 2003 issue a special permit authorising particular vehicles which contravene the maximum weight and dimensions of mechanically propelled vehicles and trailers to be used on public roads.

It is an offence under Section 12 / 13 of the Road Traffic Act, 1961 to contravene the Road Traffic (Construction and Use of Vehicles) Regulations 1963 – 2003 except in accordance with a special permit issued in respect of the vehicle(s).

Application:

An application for a Special Permit must be accompanied by the following documentation:

Insurance Schedules - Insurance Policies MUST include a specific indemnity to Galway County Council – Level of Indemnity Required:

    (a)      Public Liability                   €6.5 million

    (b)     Employers Liability            €13 million

Fee:

There is a fee of €100 for the issuing of a special permit, valid for a period of 3 months

Prior Notice

Prior to making an application for a special permit, the applicant shall give the Commissioner of the Garda Siochana 4 clear working days notice of such application.  The notice shall be accompanied by a copy of the application for the permit. 

Undertaking

An application for a permit shall contain an undertaking by the applicant to refund to Galway County Council the amount of any damage caused to any public road by the use of the vehicle(s) under the permit.

Galway County Council may for this purpose require the applicant as a condition of the permit either to deposit with the Council a sum sufficient to cover the amount of such damage, or to furnish other sufficient security.

Permit:

A permit shall at all times be carried on the vehicle to which it relates, or on the vehicle drawing the trailer to which it relates.

A permit shall be valid for a maximum of 12 months from the date of issue, or for such lesser period as may be stated it in.

Withdrawal of Permit:

Where a vehicle in respect of which a permit has been issued, is being used in contravention of any condition attached to the permit, Galway County Council may withdraw the permit.

Where Galway County Council proposes to withdraw a permit it shall give 21 day’s notice of such intention and shall consider any representations made by the holder within that period.
